A - SALES:
The prices, technical features and product references set out in our catalogues and Website may be modified without notice.
Europneumaq, Lda. has a wide range of complementary products. We therefore strongly recommend that you contact our commercial department and/or browse our Website at www.europneumaq.com.
Credit sales can only be handled once our customer form has been complete, all requested information has been provided and a set of financial criteria has been met. Credit limit is determined by Europneumaq, Lda., though the first transaction will always require payment on delivery.
These prices do not include VAT.
B - PURCHASE ORDERS:
Purchase orders will only be accepted in writing, via either fax or e-mail, or through our salesmen.
Ordered goods that are not available for immediate delivery will be held pending until stock is available; they will subsequently be shipped in the order in which purchase orders were received, unless specified otherwise by the customer in writing.
All quotes issued by Europneumaq, Lda. are valid for 60 days, after which the prices and delivery times can no longer be guaranteed, due to possible changes by our suppliers.
C - SHIPPING:
Goods are collected from the Europneumaq, Lda. premises, with the customer being responsible for their collection.
Shipments are Ex-Works unless agreed otherwise. Delivery times are merely informative and failure to comply does not grant the customer the right to claim for damages or losses arising therefrom.
Any expense pertaining to re-shipment of goods or failure to collect orders will be charged to the customer.
We emphasize that, upon receipt of the goods by the customer, they should be checked immediately for any damage that might be attributable to the carrier. In this case, the goods must not be accepted or, if they are, it should be mentioned in the ‘observations’ field on the consignment note that they were conditionally accepted due to being damaged, deteriorated or broken. This occurrence must also be reported to the Europneumaq, Lda. office, as soon as possible.
The customer has a time limit of 30 days from the date of delivery in which to lodge a complaint. If after this period no claim is received by Europneumaq, Lda., the acceptance of the goods in their delivery condition is presumed.
If the customer does not comply with the agreed payment terms, Europneumaq, Lda. may, exceptionally, ship the material by cash on delivery.
D – DELIVERY TIMES:
The delivery time given is valid for the date the quote is sent. If the purchase order is issued after the date of the quote, the delivery time should be reconfirmed and will depend on other orders pending at that time.
When the acceptance of a purchase order requires a down payment, it will only be considered upon receipt of this amount and the delivery time will consequently relate to this date.
E - RETURNS AND COMPLAINTS:
Requests for returns / complaints will only be accepted up to a maximum of 30 days from the date of the invoice and must be made in writing.
Requests to cancel / return orders should also be in writing and sent via fax or e-mail, after which they will be duly assessed by the Europneumaq, Lda. commercial department.
Any request to return material must include a copy of either the invoice or cash sale document, as well as the waybill and the return authorization form completed by our office.
We reiterate that the return of any material can only be carried out with the due consent of Europneumaq, Lda. and that collect on delivery charges will not be accepted for returns.
After requesting a return, the customer must await a response from the Europneumaq, Lda. technical department before returning the goods.
Only after considering each case can a return be granted or rejected. Under exceptional circumstances, this assessment may be the responsibility of the manufacturer/ supplier, in which case the response time cannot be forecast.
Upon acceptance of returned goods, a credit note will be issued for them and, if the goods are replaced, a replacement invoice for the new goods will be issued.
If complaints are unfounded, the customer may have to bear the transport costs.
Europneumaq, Lda. reserves the right to refuse a return request if the goods / products have been specially ordered from the manufacturer. Moreover, the return might still be accepted with the costs assigned to the customer if the supplier feels the goods have lost value.
Returned goods will only be accepted under the following conditions:
if they have been incorrectly shipped by the Europneumaq, Lda. office,
if they have not been used,
if the original packaging is intact.
A return process will only be complete after the goods have been received and checked, and their condition has been approved by the Europneumaq, Lda. office.
Any product which is not fit to be resold will not be accepted, especially if any component is missing, if it shows clear evidence of use, or if warranty seals have been broken or damaged in any way.
Should the goods show any of the signs mentioned above, the return request will be instantly rejected.
F - PRODUCT WARRANTY:
In general, all products provided by Europneumaq, Lda. have a one-year warranty period, as stipulated by the 2008 Portuguese law against manufacturing defects, including repair or replacement of goods during this period. Excluded is the normal wear and tear of parts and/or components which fail in normal operating conditions. Any damage caused by improper handling or incorrect assembly are not covered by the warranty.
The warranty does not cover, in any circumstances, either the shipping charges or the manpower required to replace the damaged components.
G - TECHNICAL SUPPORT AND TRAVEL:
If it is necessary to send a technician to the customer’s premises – or any other designated location – to perform any sort of repair or installation, or to run training sessions, the rates will be as follows:
Generic tech support: 31 Euros
Travel costs: 0,50 Euros / km
N.B.: travel is counted from when the technician leaves the Europneumaq, Lda. premises and ends on their return to the same location.
All technical support must be paid cash on delivery. An invoice will be issued within 24 hours of the technical support being completed.
H - SAMPLES FOR CUSTOMERS:
All materials / products provided to customers for trials or demonstrations will be accompanied by the respective consignment documentation, valid for a period of 15 days. After this period, if the goods are not returned to Europneumaq, Lda., in due condition, their cost will be charged to the customer, according to the usual terms of supply.
The goods may be subject to special price and payment terms, to be agreed by both parties prior to any shipment.
I - PAYMENT TERMS:
Payments will be made according to what was agreed when credit was granted, and the payment deadline is always stated on the relevant invoice. It should be emphasized that technical support charges must be paid cash on delivery, regardless of any payment terms that might have been agreed for the supply of goods.
Prices and payments can be quoted and paid in euros.
Invoice payments are sent to the Europneumaq, Lda. headquarters. In the case of cash sales, payments must be made right away.
Amounts regarding goods provided for customer tests, which are accompanied by their documentation (invoices for samples, payable within thirty days), must be paid immediately if the samples are not returned to Europneumaq Lda. within the stipulated period of time, in good working conditions and in their original packaging.
Any overdue invoices can lead to a charge for process costs, since it is the customer's responsibility to make the due payments within the time specified. Failure to meet payment deadlines can lead to the suspension of future supplies.
Under these circumstances, Europneumaq, Lda. reserves the right to charge interest at the highest rate permitted by law and to take whatever legal action is deemed necessary to pursue its interests.
J - LIABILITY:
Europneumaq, Lda. shall in no event be liable for remote, special or consequential damages caused directly or indirectly to people or property, due to the use of products provided by Europneumaq, Lda., since it is understood the installer is aware of both their technical and legal limitations, as well as of the existing regulations for the installation of such materials.
Under no circumstances will ownership of the goods pass to the buyer until full payment has been made to Europneumaq, Lda.
L – COMPETENT JURISDICTION:
Unless otherwise agreed in writing, contracts shall in all respects be construed and operate as Portuguese contracts and conform to Portuguese law.
